The current land purchasing system in the country has a lot of irregularities in its dealing as one wonders whether there are no laws or authorities responsible for securing one property.
In most cases a particular land can be sold to two or more people whereas the original and initial buyer has already made full deposits. Such instances normally result in misunderstanding between all the parties claiming possession of the land which could lead to initiating landguards who normally beat up the other members and in worst scenarios result in the death of a member. Most people have attributed this confusion to some chiefs who are peculiar with this kind of act.
Based on this, a judge at the court of Appeal, Justice Sir Dennis Dominic Adjei has warned Chiefs and other persons who engage in the double sale of lands to put an end to it as they can be jailed for up to 10 years.
Speaking on Court Nkomo on KNM TV on YouTube, the judge explained that this sentence is also a part of the punishment prescribed in the Lands Law which was promulgated recently to help deal with the numerous land litigation issues in the country.
“…If you sell land for two different people you can be jailed for five years and the maximum is ten years… you can also be fined from GHC60,000 to GHC120,000 for the same offence. He added “No judge can sentence a person found guilty to a prison term of less than five years, no, not even four years once the judge wants to imprison you then the punishment as stated in the law is a minimum sentencing of five years and maximum is 10 years.”
This law he said is applicable to everyone and not only chiefs.
